OFFICIAL RULES


  1. ELIGIBILITY/PARTICIPATION: The 2025 Dr Pepper® Harold J. Perkins Tuition Contest (the “ Contest ”) is open to nominees who are a legal U.S. residents and are high school senior football players residing in Louisiana in the greater New Orleans or the greater Baton Rouge area(each an “Eligibility Area”) who are seventeen (17) years of age or older as of the date of their entry (“Entrant”). Nominator must be a legal US resident over the age of 18 (“Nominator”). Franchisees, employees, directors and officers of Dr Pepper/Seven Up, Inc. (“ Sponsor ”), Amp Activate c/o Upshot LLC (“ Administrator ”), Harold J. Perkins, Baller Bites®️ and any of their respective affiliates, parents, subsidiary companies, and advertising and promotion agencies (collectively, the “ Released Parties ”), and members of the immediate families (spouses, parents, children, step children, siblings, step siblings, and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing, are not eligible. Employees (and their family members/household) of any retailer where a contest is promoted or held are excluded from participation in this Contest. Void outside the Eligibility Area and where prohibited or otherwise restricted by law. The Contest is subject to all applicable federal, state, and local laws . By participating in the Contest, you agree that: (1) you have read and understand the Official Rules; (2) the nominee meets the Contest eligibility requirements as explained in the Official Rules; (3) you accept and agree to be bound by these Official Rules, to Sponsor's Conditions of Use located at https://www.keurigdrpepper.com/en/term-of-use; Legal Notices and Privacy Policy as published at https://www.keurig.com/content/privacy-policy; and (4) you unconditionally accept and agree to comply with and abide by the decisions of Sponsor and Administrator, whose decisions shall be final and binding in all respects.


  1. Contest Period: The Contest begins at 12:00:00 AM Eastern Time (“ET”) on 9/8/25 and ends at 11:59:59 PM ET on 11/8/25 the (“ Contest Period ”). Throughout the Contest Period, there will be weekly entry periods (each as “Entry Period”), as detailed in the Entry Period Chart at the bottom of section 6.


3. HOW TO ENTER : During the Contest Period, visit www.drpeppertuitionwithhpj.com (“The Contest Site”) and follow the instructions to complete the required information, including submission essay outlining why the Entrant should win (collectively “Entry”). The person uploading the Entry will be deemed the Nominator on behalf of the Entrant. Each Entry must be unique. Limit of one (1) entry per Nominator , per Entry Period. Entrants may only be nominated once per Entry Period. All non-winning entries will carry forward into subsequent entry periods. Released Parties are not responsible for lost, late, delayed, misdirected, or incomplete Entries. Incomplete Entries are not eligible. Multiple Entrants are not permitted to share the same email address. Incomplete Entries, Entries generated by script, macro or other automated means, or Entries that do not fully comply with these Official Rules, or Entries which subvert the entry process, in the sole discretion of Sponsor, shall be ineligible. Proof of submission of Entry does not constitute proof of delivery or entry during the Contest Period. All entries become the exclusive property of Sponsor and will not be acknowledged. In the event of any dispute concerning the identity of any Entrant, the relevant entry will be deemed submitted by the authorized account holder. Sponsor shall determine, in its sole discretion, the eligibility of the disputed Entrant.


4. SUBMISSION GUIDELINES: Each Entry that is submitted to the Contest must comply with these Official Rules and the following Submission Guidelines. Any Entry that, in Sponsor’s sole and absolute discretion, violates these Official Rules or the Submission Guidelines below may be disqualified in Sponsor’s sole discretion. By submitting an Entry, Nominator warrants and represents that he/she and any private persons or property that is identifiable in the Entry, have consented to such use in the Entry. Sponsor reserves the right to request proof of such permission if they deem necessary, subject to disqualification if such permission cannot be obtained, regardless of how far along the Nominator is in the Entry judging or winner confirmation process.


The Entry must, in Sponsor’s sole discretion:

  • Be Entrant’s original work;

  • Be in English; and

  • Suitable for publication.


The Entry must NOT contain material that, in the sole discretion of Sponsor:

  • Disparages any person, Sponsor and/or any of its affiliates’ products, competitors, or any of the Released Parties affiliated with sponsoring, promoting or administering this Contest, or other companies;

  • Violates or infringes upon the copyrights, trademarks, or privacy, property, publicity or other intellectual property rights of any person, entity, the Keurig Dr Pepper entities, affiliates, and subsidiaries;

  • Attempts to duplicate any other submitted nominations or existing works;

  • Is hateful, tortuous, defamatory, slanderous or libelous;

  • Promotes bigotry, racism, sexism, hatred or harm against any group or individual or promotes discrimination based on a protected class under federal law;

  • Contains any personal identification, such as personal names, phone numbers or e-mail addresses, without
    permission;

  • Contains material embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead;

  • Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);

  • Promotes any activities that may appear unsafe or dangerous;

  • Is unlawful or in violation of any law;

  • Contains any sexually explicit, lewd, offensive, or other inappropriate material;

  • Is unsuitable to be entered into this Contest for any reason whatsoever, at Sponsor’s sole discretion; and/or

  • Communicates messages or images inconsistent with the positive images and/or good will to which Sponsor and/or the Released Parties wish to associate, in Sponsor’s sole discretion.

Each Nominator agrees that the Released Parties are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the eligibility of any Entry. At any time during the Contest, even if the Entry is already approved, and/or is being taken into consideration for a prize, if Sponsor determines that an Entry is not in compliance with any of the Submission Guidelines or these Official Rules, the Entry may be disqualified in Sponsor’s sole discretion and will not be eligible to win a prize. All Entries submitted will continue to the next subsequent Entry Period if not chosen as the winner in a previous Entry Period. If a Nominee becomes a Prize Winner during one Entry Period, they will not be eligible to participate in or become a Prize Winner in a subsequent Entry Period. Nominator agrees that they will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the prior written consent of Sponsor.

5. WINNERS: On or about two business days after each Entry Period, the Administrator will randomly choose one Entrant from each Eligibility Area (“Weekly Prize Winner”). There will be one (1) tuition winner from Each Eligibility Area and they will be chosen through a random drawing of Weekly Winners.


6. PRIZES/APPROXIMATE RETAIL VALUE (“ ARV ”)/ENTRY PERIODS: Once confirmed, as detailed below, the Weekly Prize Winner will receive one (1) autographed Harold J. Perkins football (ARV: $) and will be featured on a local radio station. At the end of the Contest period , all of the Weekly Prize Winners will go into another drawing to pick the final two tuition award winners. There will be one (1) winner from New Orleans and one (1) winner from Baton Rouge. Each winner will receive a Five Thousand Dollars ($5,000) Tuition Award from Dr Pepper/Seven Up administered by Scholarship America. The total Tuition Award per each potential Prize Winner is Ten Thousand Dollars ($10,000). The total ARV of the prizes is

Tuition/Educational Awards are payable as follows:


  1. As undergraduate or graduate level tuition at an accredited two-year or four-year college, university, or vocational-technical/trade school (“Eligible Institution”) to cover “Eligible Costs” defined as tuition, fees, books, supplies, equipment, related educational expenses and on-campus room and board to be awarded in the form of a check distributed to the Eligible Institution (eligible under Title IV of the Higher Education Act of 1965 as amended) and located in the United States on behalf of the Prize Winner or a single Designee, who must be at least 18 years of age or older and a legal U.S. resident;

  2. To pay off student loans incurred for Eligible Costs in the form of a check distributed to the loan servicing company on behalf of the Prize Winner or a single Designee; or

(c) A combination of Sections 6 (a) and (b) in an amount not to exceed the Tuition Award amount.


The five-thousand-dollar ($5,000) Tuition Awards will be administered by Scholarship America, Inc. (“Scholarship America”), and are subject to the following and all other terms of these Official Rules. Tuition Awards are to be used to pay current Eligible Costs, student loans incurred in a previous academic year(s) for Eligible Costs, or a combination not to exceed the Tuition Award amount. Checks for the amount of five thousand dollars ($5,000) will be sent by Scholarship America to the Eligible Institution designated by the Prize Winners or their Designees. Payments applied to educational loans will be payable to the loan servicing company for the Prize Winner or their Designee. (Tuition Awards may be considered taxable and Form 1099-Miscellaneous Income will be issued).


The five-thousand-dollar ($5,000) Tuition Awards must be used for current educational expenses until the expiration date of December 31, 2026 (the “Expiration Date”) or until a degree is earned, whichever occurs first. Following completion of a degree program, the Prize Winner may opt to continue to pursue another degree level until the award expires, is used up, or use toward existing education loans. 


Upon notification as a Prize Winner, he or she must notify Scholarship America of their intent to gift the Tuition Award to a single Designee. Scholarship America will set aside the funds until such time as the Designee notifies Scholarship America that the Designee is ready to use the funds for Eligible Costs or student loans. Any Tuition Award not used by the Expiration Date, whether for the Prize Winner or Designee, will be forfeited and returned to Sponsor. The Tuition Award proceeds shall be transferred one (1) time only to a single Designee. The Prize Winner must supply the following identifying information about the Designee to Scholarship America: name, phone number, age, relationship, and postsecondary school information (if known at such time) or the contact information for the loan servicing company. Scholarship America shall not transfer the Tuition Award to an eligible institution or loan servicing company on behalf of the Designee until such time as the identifying information is verified by the Designee and to the satisfaction of Scholarship America. The Prize Winner shall be responsible for completing and filing the required gift tax forms with the Internal Revenue Service. There may be a tax liability to the Prize Winner, and the Prize Winner should consult with a tax expert before accepting the Tuition Award. An IRS Form 1099 will be issued to the Prize Winner. Any tax liability will be the responsibility of the Prize Winner.


In no event will Sponsor be responsible for awarding more than the stated number of Tuition Awards herein. No transfer, substitution, or cash equivalent for any Tuition Awards, in whole or in part, will be permitted, except at Sponsor's sole discretion due to unavailability for any reason, and only then for a prize of greater or equal value determined solely by Sponsor shall be allowed.  The decisions of Administrator and Sponsor are final and binding on all matters relating to this Contest. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All taxes, if any, are each the responsibility of Prize Winner, their Designee, or the Prize Winner’s or Designee’s selected, Eligible Institution or loan servicing company (valued at more than $599). All prize details are at Sponsor’s sole discretion.


The decisions of Administrator and Sponsor are final and binding on all matters relating to this Promotions. Odds of winning a Prize are dependent upon the total number of eligible Entries received throughout the Promotion Period. In no event will Sponsor be responsible for awarding more than the stated Prizes herein. Prize conditions may be added or modified by companies providing those portions of the Prize. The Prize restrictions/conditions stated herein are not all-inclusive. No transfer, substitution, or cash equivalent for a Prize, in whole or in part, will be permitted, except at Sponsor’s sole discretion due to Prize unavailability for any reason, and only then for a prize of greater or equal value determined by Sponsor shall be allowed. There is a limit of one (1) Prize per person, for the entire Promotion.


7. PRIZE WINNER NOTIFICATION/VERIFICATION: Each potential Prize Winner must comply with these Official Rules in order to accept their prize and be confirmed as an official winner. On or about one (1) business day after each Contest Judging Period is complete, Administrator will notify the potential Prize Winner via email or the phone number used to enter the Contest. Upon notification or notification attempt, potential Prize Winner will be required to respond as indicated, accepting the prize, if applicable and/or providing the contact information, and providing his/her email address for Prize Winner verification purposes (if requested) within two (2) calendar days of such notification or notification attempt, or the prize may be forfeited, and an alternate potential Prize Winner may be selected and notified. Potential Prize Winner will be required to complete and return via email, a declaration of eligibility and liability and publicity release, except where prohibited (“Declaration”) within 48 hours of Administrator’s attempted delivery. Each Entrant must attest that by accepting a prize, it will not be in any violation of their employer or union contracts. Potential Prize Winners must both return their Declarations back or the Entry will be disqualified, and an alternate Entrant may be selected, in Sponsor’s sole discretion. If in any instance, notification attempt(s) for a potential Prize Winner fails to respond for any reason or is found to have not complied with these Official Rules or is not eligible, the prize will be forfeited and an alternate potential Entrant may be selected and notified (time allowing). Once Entrant has been confirmed, the Administrator will notify the potential Prize Winners via email or phone using the contact information provided from the Entry. Potential Designees will be required to respond to email notification with requested information within two (2) calendar days of such notification or notification attempt, or the prize may be forfeited. Prize acceptance constitutes permission for the Sponsor and its agents to use the name, actual or simulated likenesses, biographical information, city, state, opinions, and prize information of Prize Winner for advertising and promotional purpose(s), in perpetuity, throughout the universe, in any and all media now or hereafter devised in any manner, without additional compensation, notification or permission, unless prohibited by law. Further, Prize Winner shall indemnify the Released Parties from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from participation in this Contest, acceptance or use of any prize, or breach of these Official Rules. In the event of a dispute as to any account, the authorized account holder of the email address used to register on the promotion website will be deemed to be the Entrant and must comply with these Official Rules.


8. GENERAL TERMS/LIMITATION OF LIABILITY: Noncompliance with any of these Official Rules may result in disqualification. Released Parties assume no responsibility for late, lost, jumbled, incorrect, or inaccurate entries, whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error. The Released Parties are not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any email, technical problems or traffic congestion on the Internet or at any website including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation in this Contest. Released Parties are not responsible for any typographical or other error(s) in administration of the Contest, or in the selection/announcement of the Prize Winners. If, for any reason, the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. Should the Contest be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the prizes will be awarded via random drawings from among all eligible Entries received for each drawing up until the time of termination, or in a manner that is fair and equitable as determined by Sponsor. All interpretations of these Official Rules and decisions by Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated tweets are permitted. Sponsor reserves the right in its sole discretion to disqualify any individual it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated online tweet; (ii) to have tampered with the participation process or the operation of this Contest; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Contest. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Participants agree that the Released Parties, (a) shall not be responsible or liable for, and hereby release the Released Parties from any claims, losses, damages or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the Contest or any Contest-related activity, or from acceptance, receipt, possession and/or use/misuse or inability to use a prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to a prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. The Released Parties shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties; or (3) by any other cause, condition or event whatsoever beyond the control of the Released Parties. Failure of Sponsor to enforce any provision herein shall not be deemed a waiver of such. UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL SPONSOR BE LIABLE TO ANY PARTICIPANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS CONTEST. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect.


9. GOVERNING LAW/VENUE: THE CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN TEXAS. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF. THE RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED IN PROMOTIONAL LAW AND LICENSED TO PRACTICE LAW IN TEXAS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF COLLIN OR DALLAS, TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ENTRANTS BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
